Terms of Service

1. Acceptance of Terms

By accessing or using Intelli-Rent ("Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Platform.

2. Platform Purpose

Intelli-Rent is a community platform that allows tenants in Luxembourg to share experiences and rate rental properties, agencies, and legal firms. Reviews are displayed anonymously to protect user privacy while providing valuable information.

3. User Accounts

3.1 Registration

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must be at least 16 years old
• One account per person

3.2 Anonymous Reviews

Reviews are displayed without your name or email. However, we retain your user ID internally for moderation and legal compliance purposes.

4. Review Guidelines & Content Standards

4.1 Permitted Content

Reviews must:

• Be based on your genuine personal experience
• Contain factually accurate statements
• Reflect your honest opinion
• Relate to the property, agency, or legal firm being reviewed

4.2 Prohibited Content

You may not post reviews that:

• Contain demonstrably false statements of fact
• Are defamatory or libelous (under Luxembourg Civil Code)
• Violate privacy rights (e.g., publishing private information without consent)
• Contain hate speech, discrimination, or harassment
• Include spam, advertising, or promotional content
• Violate intellectual property rights
• Are submitted by competitors or have conflicts of interest
• Contain obscene or graphic content

4.3 Accuracy Requirement (GDPR Article 5)

We are required to take reasonable steps to ensure reviews are accurate. If you realize a review you posted contains an error, please contact us immediately to request correction.

5. Content Moderation

5.1 Our Role

We reserve the right (but have no obligation) to review, moderate, edit, or remove content that violates these Terms. We act as a neutral hosting platform and are not responsible for user-generated content.

5.2 Flagging System

Users can flag reviews they believe violate these Terms. We review flagged content within 5 business days.

5.3 Automated Moderation

We may use automated systems to detect spam, abuse, or policy violations.

6. Dispute Resolution for Property Owners/Landlords

6.1 Notice and Takedown (E-Commerce Directive 2000/31/EC)

If you are a landlord, property owner, or agency and believe a review:

• Contains false statements of fact
• Is defamatory
• Violates your legal rights

You may submit a takedown request to legal@intelli-rent.lu with:

• Your identity and proof of ownership/management
• The specific review URL
• Detailed explanation of the false/unlawful content
• Supporting evidence (lease agreements, photos, correspondence, etc.)
• Your contact information for follow-up

6.2 Investigation Process

Upon receiving a valid notice:

1. We will acknowledge receipt within 2 business days
2. We will investigate the claim and may contact the review author
3. We will make a decision within 5-10 business days
4. If content is proven false/unlawful, we will remove or correct it expeditiously

6.3 Counter-Notices

If your review is disputed, we may contact you to provide evidence supporting your claims. You will have 5 business days to respond.

7. Liability and Disclaimers

7.1 Platform Disclaimer

The Platform is provided "as is" without warranties of any kind. We do not guarantee:

• The accuracy or completeness of user reviews
• Uninterrupted or error-free service
• That reviews reflect the current state of a property

7.2 User Liability

You are solely responsible for the content you post. You agree to indemnify and hold harmless Intelli-Rent, its operators, and affiliates from any claims, damages, or legal costs arising from your content or violation of these Terms.

7.3 Platform Liability

As a hosting service under EU E-Commerce Directive 2000/31/EC, we are not liable for user-generated content provided that:

• We do not have actual knowledge of illegal activity
• We act expeditiously to remove/disable illegal content upon obtaining knowledge
• We do not actively edit or control user content

8. Intellectual Property

8.1 Your Content

You retain ownership of reviews you post. By posting, you grant us a non-exclusive, worldwide, royalty-free license to display, store, and distribute your content on the Platform.

8.2 Our Content

The Platform design, logo, and original content are owned by Intelli-Rent and protected by intellectual property laws.

9. Account Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Post fraudulent or false reviews
• Engage in abusive behavior
• Violate applicable laws

You may delete your account at any time via your profile settings.

10. Data Protection

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data under GDPR.

11. Governing Law

These Terms are governed by the laws of the Grand Duchy of Luxembourg. Any disputes shall be resolved in the competent courts of Luxembourg City, without prejudice to mandatory consumer protection provisions applicable in the user's country of residence under EU law.

11b. Out-of-Court Dispute Resolution

The EU Online Dispute Resolution (ODR) platform previously established by Regulation (EU) No 524/2013 has been discontinued following its repeal by Regulation (EU) 2024/3228 (19 December 2024). The platform is no longer available.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
