Intelli-Rent ("we", "our", "us") operates as the data controller for personal data collected through this platform. Intelli-Rent is established in Luxembourg (Grand Duchy of Luxembourg).

2. Data We Collect

2.1 User Account Data

When you create an account, we collect:

  • Email address
  • Full name
  • Account creation date
  • User role (admin/user)

2.2 Review Data

When you submit a review, we collect:

  • Property address (publicly visible)
  • Ratings and review text (publicly visible)
  • Review submission date
  • Your user ID (not publicly visible - reviews are displayed anonymously)

2.3 Technical Data

We automatically collect:

  • IP addresses (for fraud prevention and security)
  • Browser type and version
  • Device information
  • Usage data and analytics

2b. Data Collected Indirectly (Art. 14 GDPR)

Where personal data is not obtained directly from you, we collect the following:

  • IP addresses & technical logs: Automatically collected by our hosting infrastructure for security and performance purposes. Source: your internet service provider / device.
  • Proof documents (rental contracts, utility bills): Uploaded voluntarily as part of the review verification process. These may contain personal data of third parties (e.g. landlord names, addresses). We process only what is necessary to verify your tenancy. Documents are not publicly displayed.

In accordance with Art. 14.3 GDPR, this information is provided at the time of first contact or data collection.

3. Legal Basis for Processing (GDPR Article 6)

We process your personal data under the following legal bases:

  • Consent: When you create an account and submit reviews
  • Legitimate Interests: Platform security, fraud prevention, and service improvement
  • Legal Obligation: Compliance with EU and Luxembourg law, including responding to legal requests

4. How We Use Your Data

We use your personal data to:

  • Provide and maintain the review platform
  • Display reviews anonymously to help tenants make informed decisions
  • Prevent fraud, spam, and abuse
  • Respond to legal requests and enforce our Terms of Service
  • Improve platform functionality and user experience
  • Communicate important service updates

5. Data Sharing

We do not sell your personal data. We may share data with:

  • Service Providers: Hosting, analytics, and email services (all GDPR-compliant)
  • Legal Authorities: When required by law or court order
  • Public Display: Reviews are displayed anonymously (without your name or email)

5b. Mandatory vs Optional Data (Art. 13.2.e GDPR)

When creating an account or submitting a review, the following applies:

  • Email address: Mandatory — required to create an account and verify your identity
  • Full name: Mandatory for account registration
  • Property address in reviews: Mandatory — necessary to associate the review with a property
  • Ratings (price, cleanliness, noise, etc.): Mandatory — core purpose of the review
  • Review text: Optional — you may submit ratings without a written comment
  • Proof document (rental contract/utility bill): Optional — uploading it enables AI-verified badge but is not required
  • Apartment unit number, move-out date: Optional — provided at your discretion

Failure to provide mandatory data will prevent submission of the relevant form. Optional data will simply not be processed or displayed.

6. Your Rights Under GDPR

You have the following rights regarding your personal data:

6.1 Right of Access (Article 15)

Request a copy of all personal data we hold about you.

6.2 Right to Rectification (Article 16)

Request correction of inaccurate or incomplete data.

6.3 Right to Erasure (Article 17)

Request deletion of your personal data. Note: We may retain certain data if required by law or for legitimate business purposes (e.g., defending legal claims).

6.4 Right to Restrict Processing (Article 18)

Request limitation of how we process your data.

6.5 Right to Data Portability (Article 20)

Receive your data in a structured, machine-readable format.

6.6 Right to Object (Article 21)

Object to processing based on legitimate interests.

6.7 Right to Withdraw Consent

Withdraw consent at any time (this does not affect lawfulness of prior processing).

7. Review Accuracy & Content Moderation

Under GDPR Article 5 (accuracy principle), we maintain a content moderation system:

  • Users can flag reviews containing false or defamatory content
  • Property owners/landlords can dispute reviews via our Notice and Takedown Process
  • We review flagged content within 5 business days
  • Demonstrably false reviews will be removed or corrected

8. Notice and Takedown Process (E-Commerce Directive 2000/31/EC)

As a hosting service provider, we comply with EU safe harbor provisions. If you believe a review contains:

  • Defamatory or false statements
  • Personal data that should not be published
  • Illegal content

Submit a takedown request to legal@intelli-rent.lu including:

  • Your identity and contact information
  • The specific review URL or property address
  • Detailed explanation of why the content is unlawful or false
  • Supporting evidence (documents, photos, etc.)

We will investigate and act expeditiously, typically within 5 business days.

9. Data Retention

  • Account Data: Retained while your account is active, or as required by law
  • Reviews: Retained indefinitely unless deletion is requested or content is found to violate our policies
  • Technical Logs: Retained for 12 months for security purposes

10. Data Security

We implement appropriate technical and organizational measures including:

  • Encryption of data in transit (HTTPS/TLS)
  • Secure database access controls
  • Regular security audits
  • Staff training on data protection

11. International Data Transfers

Your data may be processed in countries outside the EU. We ensure adequate safeguards through:

  • Standard Contractual Clauses (SCCs)
  • Adequacy decisions by the European Commission
  • GDPR-compliant service providers

12. Children's Privacy

Our service is not intended for individuals under 16. We do not knowingly collect data from children.
